Terms of Service

Version 2026-05-06 · Effective from launch

Welcome to Colour Matcher ("the Service"), operated by W4D ("we", "us"). By creating an account or using the Service, you ("you", "User") agree to these Terms.

1. Account & eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account. You're responsible for keeping your login credentials confidential and for all activity under your account. You agree to provide accurate information when registering and to keep it up to date.

2. Free and paid plans

Colour Matcher offers a free plan with usage limits (currently up to 3 palettes, 3 gradients, 1 board with single-recipient view-only sharing, no AI features) and paid plans that increase or remove these limits. Paid plans are billed monthly and may be cancelled at any time; you retain access until the end of your current billing period.

3. Your content and the licence you grant us

You retain ownership of all content you upload to or create within the Service, including images, palettes, gradients, boards, names, and notes ("Your Content").

By submitting Your Content to the Service, you grant W4D a worldwide, royalty-free, perpetual, irrevocable, sublicensable licence to host, store, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display Your Content for the following purposes:

(a) operating, providing, and improving the Service; (b) developing new features, products, and services, including training and improving artificial-intelligence and machine-learning models; (c) marketing and promoting the Service, including showcasing example outputs; and (d) any other purpose consistent with the operation of the Service.

You warrant that you have all rights necessary to grant this licence and that Your Content does not infringe the intellectual-property, privacy, or other rights of any third party.

4. AI-generated outputs

The Service uses third-party AI models (currently Google Gemini) to generate palettes, names, briefs, recolours, and other outputs. You acknowledge that AI outputs may be inaccurate, derivative, or similar to outputs delivered to other users. You're responsible for reviewing outputs before relying on them commercially.

5. Acceptable use

You agree not to: (a) upload content that's unlawful, infringing, defamatory, obscene, or harmful; (b) attempt to reverse-engineer, scrape, or interfere with the Service; (c) use the Service to develop a competing product; (d) impersonate others or misrepresent your affiliation; (e) violate any applicable law.

6. Termination

You may delete your account at any time. We may suspend or terminate your account if you breach these Terms, abuse the Service, or fail to pay for a paid plan. On termination, your access ends, but the licence in Section 3 over Your Content survives where reasonably necessary for the operation of the Service.

7. Disclaimers and limitation of liability

The Service is provided "as is" without warranties of any kind, to the maximum extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or that AI outputs will be accurate. To the fullest extent permitted by law, our total liability to you shall not exceed the greater of (a) the amount you have paid us in the twelve months preceding the claim, or (b) £100.

Nothing in these Terms limits liability for death, personal injury caused by negligence, fraud, or any other liability that cannot be limited under applicable law.

8. Privacy

We process personal data in accordance with our Privacy Policy. You have rights under the UK GDPR including access, rectification, erasure, and portability — see the Privacy Policy for how to exercise them.

9. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified by email and require re-acceptance on next sign-in. The current version is shown at the top of this page.

10. Governing law

These Terms are governed by the laws of England and Wales. Disputes are subject to the exclusive jurisdiction of the courts of England and Wales, except where mandatory consumer-protection law in your country of residence grants you additional rights.
